Mediation is a process in which a trained mediator works with disputed parties to help them develop an agreement on the contended issues in their case. In this role, the mediator encourages and facilitates resolution of disputed issues by fostering joint problem solving, consensus building among parties, and exploration of alternative settlements. This allows parties to develop their own agreement, rather than having the judge decide the issues. Mediation can result in a more expedient resolution to the case, reduced costs, and more acceptable results for both parties. All information and communications during mediation are confidential (except as provided by law), and will not be provided to the court.
In mediation, the parties retain the ultimate control of whether and on what terms their dispute is negotiated and resolved. While the parties select a neutral to assist them in mediation, that neutral is only a facilitator, not a decision maker.
In mediation, each party has the opportunity to have private, confidential, ex parte exchanges with the neutral serving as mediator, confident that the mediator may not disclose any information shared without the party’s express direction to do so. And, as in early neutral evaluation, nothing shared or discussed in a mediation is admissible at trial and the mediator may not be compelled to testify. This individual confidentiality creates the type of candid communication necessary for the mediator to effectively assist the parties with their individual assessments and negotiating strategy.
